The Council of the Village of Riverlea met on the above date for a Special Meeting at 230 W Riverglen Dr, Worthington. The following Council members were present: Mayor Eric A. MacGilvray, Marc Benevento, Chad A. Lowe and Josh Schoenberger. Also present were Joshua C. Mehling, Clerk-Treasurer, L. Leah Reibel, Solicitor, and William P. Charles, Street Commissioner. Guest of Council was Jim Dippel of Burgess & Niple. At 7:06 p.m. the Mayor called the meeting to order.
The minutes of the regular Council meeting of May 16, 2016 were not read since each member had received a copy. Benevento moved and Lowe seconded the motion that the minutes be approved as submitted by the Clerk-Treasurer. The following votes were recorded on the motion: Yes – 2: Benevento, Lowe; No – 0; Abstain – 1: Schoenberger. The motion carried (2-0- 1).
Prior to the meeting, the Clerk-Treasurer had distributed the proposed 2017 tax budget for the Village to all Council members. Benevento questioned whether the $11K for curb and gutter repair included the pot hole repairs, and the Clerk-Treasurer responded that it was included in this fund. Lowe moved and Benevento seconded the motion to approve the 2017 tax budget. The motion carried (3-0).
Resolution 2016-07, A Resolution to Request the Franklin County Budget Commission to Grant the 0.65 in Inside Millage to the Village of Riverlea, Ohio was introduced by Lowe. Schoenberger moved and Benevento seconded the motion to strike the third “Whereas” statement, in which it stated that the Village was investigating storm and sanitary sewers. The motion carried (3-0). Schoenberger moved and Lowe seconded the motion to waive the three readings of this resolution in order to submit the resolution to the County in a timely fashion. The motion carried (3-0). Schoenberger moved and Lowe seconded the motion to adopt this resolution. The motion carried (3-0).
Storm Sewer Outfall Repair Work
The Solicitor reported that further review of the agreement relating to the storm sewer outfall repair work revealed that the original OPWC grant would not cover replacement of the sod in the yard once the project was finished. Jim Dippel of Burgess & Niple stated that the cost to replace the sod would have been $3,900, and the reimbursement sought by the homeowner for replacement of trees was about $1,300. Schoenberger stated that any sort of reimbursement to the homeowner should include an agreement limiting future liabilities and the Solicitor agreed with this. Lowe moved and Benevento seconded the motion for the Village to reimburse the homeowner for the replacement of the trees, but not for reimbursement of legal fees. The motion carried (3-0). The Street Commissioner will work with Burgess & Niple on executing a change order with the Contractor and the Solicitor will work with the homeowner to create & sign a Memorandum of Understanding before the reimbursement is paid.
Resolution 2016-08, A Resolution to Provide for the Acquisition of Consulting Services from Burgess & Niple to Assist in Applying for the State Capital Improvements Program (SCIP) Grant/Loan to Help Finance the Village’s Water Distribution System and Street and Drainage Reconstruction Project, and to Declare an Emergency was introduced by Benevento. Schoenberger moved and Lowe seconded the motion to waive the three readings of the resolution in order to enable the Village to submit the application before the deadline. The motion carried (3-0). Schoenberger moved and Benevento seconded the motion to adopt this resolution. The motion carried (3-0).
There being no further business, Schoenberger moved and Benevento seconded the motion to adjourn. The motion was approved unanimously (3-0). The meeting was adjourned at 7:27 pm.
