WHEREAS, the Council of the Village of Riverlea deems it necessary to provide for police protection for the Village and to provide compensation for such protection; and
WHEREAS, the Village of Riverlea is located adjacent to the City of Worthington, Ohio, and the Council of the Village of Riverlea has determined to contract with the City of Worthington and the Worthington Police Department to provide such police service and protection for the safety of Village residents and property and to provide compensation for such protection;
WHEREAS, the City of Worthington has proposed and presented to the Mayor of the Village a contract that provided for a one-year term at an annual amount that does not exceed $67,240, plus an additional contingent fee for investigative services that shall not exceed $15,000, and the Council of the Village of Riverlea desires to ratify and accept such contract for such term.
Be It Resolved By The Council Of The Village Of Riverlea, State Of Ohio:
Section 1. Authorization to Execute Contract. That the Mayor be and he hereby is authorized and directed on behalf of the Village of Riverlea, Ohio, to enter into an appropriate Agreement with the Columbus City Attorney’s Office for provision of certain legal services for the period from January 1, 2016 through December 31, 2016. The Village shall pay a flat fee for such legal service for each matter or case undertaken, plus certain other additional charges and reimbursement of expenses, generally in accordance with the schedule attached as Exhibit A to this Resolution entitled "Columbus City Attorney's Office, Prosecutor Division - 2016 Billing Structure".
Section 2. Appropriation. That the funds necessary to carry out the purposes of this Resolution have heretofore been appropriated.
Section 3. Emergency Effective Date That this Resolution is declared to be an emergency measure, effective upon passage, and immediately necessary for the preservation of the health, peace, safety and welfare of the residents of the Village of Riverlea. Such emergency exists in the Village because the Council meets only once a month, and three readings cannot be held before the contract expires. Accordingly, this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.
Section 4. Open Meetings This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.
Section 4. Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance, or a summary of this Ordinance, shall be published by posting copies of this Ordinance or a summary hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:
Council of the Village specifically authorizes the Clerk-Treasurer, in lieu of the publication of this Ordinance and all of the attachment hereto, to publish a summary of this Ordinance and its attachment as permitted by Ohio Revised Code Section 731.21, provided that the Clerk-Treasurer shall deliver a complete copy of this Ordinance and its attachment to any person requesting the same upon payment by such person of the actual costs incurred by the Village to prepare such copy. Copies of this Ordinance or of the summary of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (15) days.
